The former host of the “Today” show is officially divorced.

The divorce of Matt Lauer and Annette Roque was initiated because of the of multiple allegations of sexual misconduct against Lauer.

Lauer and Roque’s case was uncontested and it is believed that Roque received up to $20 million in assets including a horse farm in the Hamptons. Custody of their three children will be shared.

How Lauer’s Case Applies to You

Florida is a no-fault divorce state, meaning you don’t need a reason to file for divorce other than “irreconcilable differences” so whether your spouse had an affair or not is not relevant. But what is relevant is the dissipating of marital assets because of the extra-marital affair.

No-Fault Divorce States

Monies being spent on an affair is considered dissipating marital assets, and while there will always be money spent by a cheating spouse, the question is how much.

For example, vacations and dinners may be some of the expenses discovered, but it is usually not worth the time and definitely the money, to seek credits for what may be small amounts.

However, I once had a case where I was able to discover that the husband had purchased a home for his mistress and the home was paid for in cash, and thus, my client was entitled to half the value of that home.
